Abstract

Overcrowding has been a classic problem facing the modern prison system since its invention in the 19th century. Overcrowding can be regarded as a social phenomenon that occurs when the demand for space in a prison exceeds the capacity of the place itself. This phenomenon then calls into question the ability of the prison system to meet the basic needs of its inmates when in these situations, such as the need for health care, food, and accommodation. Overcrowding also touched on the problem of the prison's inability to provide rehabilitation, training, education and recreational activities for its residents. By using qualitative research methods and in-depth interviews with selected research sources, it can be explained that as Permenkumham Number 10 of 2020 concerning Conditions for Granting Assimilation and Integration Rights for Prisoners and Children in the Context of Prevention and Overcoming the Spread of Covid-19, is one of the efforts of the Ministry of Law and Human Rights of the Republic of Indonesia so that the number of occupancy in Lapas/LPKA/Rutan centers is reduced so that Covid-19 does not spread widely. It is also basically concluded that it can describe the problem of Overcrowding in the Correctional Institution. By maximizing the parole program to unravel the problems or tangles caused by overcrowding, through parole program policies is a key factor that needs to be considered in understanding the high rate of imprisonment. In some countries parole has made a significant contribution to making prisons less overcrowded.
