Abstract

Rape is a crime that is very cruel, immoral, shameful and contrary to existing norm. Those who are voctims of rape are woman who are either adults or children who are underage, but underage children are more likely and vulnerable to be victims of rape due to their weak physical and mental condition. As the case of rape in decition No : 431/Pid.Sus/2017/PN Prp that occured in the village Bangun Purba Timur Jaya, Rokan Hulu Regency where a father raped his own children with violence or threats of violence continously, for approximately four years. The main problem in this research is how the role of the victim in the occurence of rape with violence or the threat of violence by her own biological father continues on the decision No : 432/Pid.Sus/2017/PN Prp as well as how the protection the provided by the Rokan Hulu Police and Women’s Services Unit (UPPA) to rape victims in Rokan Hulu. This type of research is observation conducted by survey, which is conducting research directly to the study site by using interviews as a data collection tools. While seen from its nature, this research is descriptive in nature which means providing a clear, detailed, and systematic description of the main problems of the study. From the results of this study it can be concluded that, the role of the victims in the occurence of rapewith violence or the treath of violence by her own biological father is that the victims has no role and is not guilty at all, which means that the perpetrators are compeletly wrong. Where as regarding the protections provided by UPPA for rape victims children, they are keeping the victims identity a secret, retraining her mentality, being examined by a female police officer, being examined in a special room, receiving a report, giving a notice of the progress of the investigation, and checking the location of the case.
