Abstract

Termination of employment is regulated in articles 150 to articles 170 UU No. 13 of 2003 concerning Manpower, the mediator dispute resolution process of the Riau Province Manpower and Transmigration Office Carry out the tasks according to Law Number 2 of 2004, by bipartite, mediation, conciliation, arbitration and settlement in the Industrial Relations Court, Settlement of mediations was not reached peace, because of the results of mediation. The main problem, namely how the implementation of termination of employment at the mediation level in the framework of resolving industrial disputes disputes at the Riau Province Manpower and Transmigration Office and what are the obstacles in the context of settling disputes at the mediation level in the context of industrial relations disputes settlement according to the Law Invite No. 2 of 2004 concerning Settlement of Industrial Relations Disputes at the Riau Province Manpower and Transmigration Office. This type of research, namely by means of surveys, research takes samples from a population and uses interviews as a primary data collection tool. The nature of descriptive research is to describe the state of the subject or object of the present research based on facts that appear as they are. The implementation of the settlement of termination of employment (PHK) at the mediation level in the Riau Province Manpower and Transmigration Office, where the mediator acts as a neutral and mediating party, helps to escalate the problem and find a solution to the disputes encountered, the implementation is carried out by the mediator through the pre-stage mediation and mediation stage, at the pre mediation stage the mediator collects background information and disputing facts, at the mediation stage, the mediator carries out mediation in accordance with his capacity to be able to produce appropriate solutions so that Termination of Employment can be avoided and impartially and neutral in resolving disputes , Barriers to the Implementation of Settlement Settlement Termination of employment at the mediation level at the Office of Manpower and Transmigration, namely: Far to hold mediation makes the parties who want to carry out mediation are reluctant to come from one party or both parties, at added economic factors that make them think to come when called to carry out mediation as well as the lack of good faith of both parties and tend to want to continue the dispute through judicial decisions without thinking about the losses incurred by the parties.
