Abstract

Problems in the implementation of auction cancellations in the sale of auction objects that occur because of mortgage rights at auction occur because of a rebuttal or lawsuit from the debtor also due to the debtor party who objected to the implementation of the auction conducted by the creditor through the auction agency. As for the formulation of the problem in this study, namely first, how to implement the cancellation of the auction as a form of legal effort to object to the implementation of the auction based on law number 4 of 1996. Second, what are the obstacles in implementing the cancellation of the auction as a form of legal effort to object to the implementation of the auction based on law number 4 of 1996. This research is classified in the type of empirical sociological writing, where the author goes directly to the field to obtain primary and secondary data. Which data is used to obtain a number of information related to this research. While the nature of the research used is descriptive, namely describing a research result by examining or analysing a statement clearly, in detail and completely. From the results of research and discussion that the authors get from this research is the implementation of auction cancellation and the examination process at auctions, namely the registration, submission, examination, proof and decision. While the obstacles in the implementation of the cencellation of the auction, namely the refusal of the defendant, the sale of the object of the auction and the execution.
