Abstract

The Loan Program, in Swamitra Savings and Loans, is a cooperative formed in collaboration with Bank Bukopin and cooperatives, the reason this cooperative was formed is to assist the community in providing loan funds both for doing business and so that people are not trapped in the traps of loan sharks that make people miserable. Borrowing and borrowing is also mentioned in Article 1754 of the Civil Code.The formulation of the problem in this study is the implementation of the loan agreement with Swamitra Savings and Loans in Sukajadi District, Pekanbaru City and the factors causing default in the settlement of loan agreements with Swamitra Savings and Loans in Sukajadi District, Pekanbaru City. While the form of this method is empirical legal research (Observational Research) by conducting legal identification and analyzing relevant and applicable laws and regulations. The author uses purposive sampling method in collecting data by interviewing Swamitra Savings and Loans in Sukajadi District, Pekanbaru City and to the parties as customers who make loans in 2020 using a questionnaire. The loan agreement at Swamitra Savings and Loans, Sukajadi District, Pekanbaru City is a standard agreement, the standard agreement is an agreement that has been determined and has been stated in a form. Basically this agreement is based on will and trust. This shows that the party making the loan has made an agreement, both the risks to be borne and others. Factors causing default in the loan agreement with Swamitra Savings and Loans, Sukajadi District, Pekanbaru City are divided into economic factors, climate factors, and intentional factors.
