Abstract

Bengkalis Police Criminal Unit, dismantling Indonesian Workers' brokers illegally. Two perpetrators were arrested named Jonandi and Dodi 71 passports and Rp. 19 million in evidence. The perpetrators committed acts criminal immigration. Both perpetrators were arrested while at a travel window. At that location too secured 17 migrant workers who will reveal the illegal TKI broker syndicate began when Criminal Investigation officers received information that there were TKI candidates at the scene who will leave for work to Malaysia without going through SIP3MI services, and from the information, the police went to the travel counter and when he arrived at the location. Actually, the perpetrators and victims are both engaging in evil agreements for the implementation of this action, it can be seen that the perpetrators and victims work together so that the victim can get abroad and work there with illegal means, and this indirectly involved the victim in the incident an act that violates the Immigration law. Countermeasures crime is not only focused on the emergence of crime or the methods used in solving the perpetrators of crime. There is another thing that is no less important again namely: the problem of victims of crime, which under certain circumstances can be triggers kajahatan. Based on the background of the problem that the author described above, then the author establishes the first occurrence of human trafficking Going Abroad to Work as an Illegal TKI in the Legal Area of ​​the Police Station Bengkalis, while the second is about criminal liability Crimes Against Human Smuggling Out of the Country to Work as TKI Illegal in the Bengkalis Police Legal Area. This writing when viewed from the type of research, using the method Observational research is by survey, which is the author direct research location to obtain the data needed with using data collection tools such as interviews. The nature of this research is descriptive which means this research provides a clear and detailed picture. The crime of people smuggling out of the country to work as an Illegal TKI in the Bengkalis Police Legal Area is a criminal offense carried out by Travel Agents or PPTKIS in sending CTKI / TKI go abroad, especially in the State of Malaysia, which is a violation which is administrative in nature, so the sanctions received by the Travel Agent or PPTKIS is also only in the form of administrative sanctions. Therefore deep law enforcement for the Prevention of Illegal Indonesian Workers (TKI) To Malaysia it is needed again by giving strict sanctions against the para Travel Agents and also for Illegal Migrant Workers, because besides being a victim, they also participated in committing criminal offenses The Criminal Liability for Criminal Acts of Human Smuggling Going Abroad to Work as an Illegal TKI in the Regional Police Legal Area Bengkalis is criminal liability for the perpetrators of criminal acts human smuggling contained in the provisions of Article 120 paragraph (1) of Law no. 6 In 2011 specifically in handling criminal offenses related to Prevention of Illegal Indonesian Workers (TKI) to Malaysia.
