Abstract

This research was motivated by the absence of rules regarding the detention of workers' diplomas in employment relations. The cause of thedetention of workers' diplomas is caused by the absence of rules that discuss thedetention of workers' diplomas by employers so that there is no obstacle when theemployer makes a work agreement that attaches a detention certificate. From the background, the author can formulate the main problemsincluding: First, how is the review of the detention of workers' diplomas byemployers in work relations in the perspective of Human Rights. And second, what are the legal consequences of the detention of workers' diplomas inemployment. This study aims to analyze how juridical assessment of the detention ofworkers 'diplomas by employers in work relations in a human rights perspectiveand to find out what are the legal consequences of the detention of workers'diplomas by employers in work relations. Research in this compilation is included in the type of normative legalresearch, namely research that intends to examine legal norms, research on legalprinciples, research on legal systematics, research on the degree of legalsynchronization, legal history research and comparative legal research. In thisstudy interviews were conducted with several speakers to strengthen data fromstudy theories. Normative research is one type of research on two data. Whereasseen from its nature is descriptive analysis. From the results of the study, it is known that the implementation ofregulations on the detention of workers' diplomas by employers in employmentrelations does not yet have legal certainty. This is evidenced by the absence ofrules governing the prohibition or allowing detention of diplomas by employers in work relations. This study shows that there is a legal vacuum in regulating therules for the detention of workers 'diplomas by employers so that many employersand workplaces arbitrarily make arrangements by entering the contents of theagreement to hold workers' diplomas. The detention of workers' diplomas isincluded in human rights violations. Keywords: Diploma Detention, Employment Relations, Human Rights.
