Abstract
The formulation of regulation concerning witness and victims protection in Act of No. 13 of the year 2006 still contains some defects. The most important one is related to the scope of the protection provided by the Act which only covered a guarantee to the witness and victims in giving their testimony in the legal process, but do not cover the protection or giving attention to the victim's detriment (financial loss). In some Articles of the Act contains also some juridical defect due to the overlapping of legislation with other Acts. Beside, there have been some laxities concerning with the criminal punishment system due the absence of criminal qualification.
