Abstract

The problem with this auction is that goods that have been sold become the rights and responsibilities of the buyer and must immediately take care of the goods. If the land and or buildings that have been auctioned are in a state of occupation, then the emptying of the building is entirely the responsibility of the buyer. In the Grosse Deed of this auction minutes, the Dumai City State Wealth and Auction Auction Office is not responsible for problems that arise and are experienced by the auction winner. The main problems in this study are how to guarantee the protection of auction winners over the execution of mortgage rights based on Grosse Deed and how to resolve disputes on the execution of mortgage rights based on the grosse deed. The research method used in this research is normative legal research and empirical legal research. To answer the problem of the Grosse Deed of Minutes of Auction Number: 088/12/2018 dated March 23, 2018. While empirical legal research this research is based on the rule of law. The nature of this research is descriptive analysis research. The results of the study, guaranteed protection against auction winners over the execution of mortgage rights. The auction winner does not legally get protection from the results of the Grosse Deed of the minutes of the auction nor from the Dumai City KPKNL with a quote, if there are legal issues in the future after reading the Grosse Deed of the auction minutes, the Dumai City KPKNL is not responsible.While the Savings and Loan Cooperatives of Friends of the True Partners of the PekanbaruBranch it only helps morally through its legal counsel to submit an application for execution to the Bengkalis District Court. As well as the costs incurred in solving this problem borne entirely by the winner of the auction. Settlement of disputes regarding the execution of mortgage rights.No longer profitable auction winners who buy land and buildings at the price of the initial debtor's remaining debt.But the auction winner feels disadvantaged by the problem after buying land and the building. Upon the settlement of the dispute, the auction winner must submit an application to the Bengkalis District Court to execute a plot of land and buildings with a land area of 700 M2, with costs incurred for the application borne by the auction winner. As well as the winning bidder is also charged the cost of processing the transfer of SHM name.
